Welcome to ChitrakootYatra.com. By accessing our website, booking our services, or interacting with our platform, you agree to comply with and be bound by the following Terms and Conditions. These terms constitute a legally binding agreement under the Indian Contract Act, 1872, and the Information Technology Act, 2000. Please read them carefully.
1. Role as an Intermediary (Aggregator)
ChitrakootYatra.com operates strictly as an online travel aggregator and facilitator. Our platform connects pilgrims and tourists with independent third-party service providers, including but not limited to hotel operators, taxi/cab drivers, local tour guides, and temple priests.
Under Section 79 of the Information Technology Act, 2000, we act as an intermediary. We do not own, operate, or directly control the vehicles, accommodations, or independent staff providing the final services. Therefore, the actual contract for service provision is strictly between the User and the respective Third-Party Vendor.
2. Limitation of Liability
Warning: Assumption of Risk
By booking through ChitrakootYatra.com, you acknowledge that travel involves inherent risks. To the maximum extent permitted by Indian Law, ChitrakootYatra.com, its owners, and affiliates shall NOT be held liable for:
- Any personal injury, accident, death, or sickness occurring during the trip.
- Loss, theft, or damage to personal baggage, cash, or electronics.
- Delays, missed trains/flights, or itinerary changes caused by vehicle breakdown, heavy traffic, weather, or driver conduct.
- Deficiency in services provided directly by hotels (e.g., AC malfunction, room quality) or transport providers.
In the event of a road traffic accident, all compensation or liability claims must be directed exclusively to the commercial vehicle’s insurance provider and the driver/owner of the vehicle. ChitrakootYatra.com holds no legal or financial liability in such matters.
3. User Responsibilities & Conduct
- Mandatory Identification: As per Government of India regulations, all guests (including children) must carry a valid original Photo ID (Aadhaar Card, Passport, or Voter ID) for hotel check-ins and police verifications.
- Medical Fitness: Chitrakoot is a geographical and pilgrimage terrain involving walking (such as the Kamadgiri Parikrama) and climbing (Hanuman Dhara). It is solely the User's responsibility to ensure they are medically and physically fit for the journey.
- Code of Conduct: Chitrakoot is a holy city. Users are expected to maintain the sanctity of the temples, ghats, and ashrams. We, or our local vendors, reserve the right to terminate services without a refund if a guest engages in illegal activities, public intoxication, or disrespectful behavior.
4. Booking, Payments & Disputes
All tour packages, hotel bookings, and taxi reservations are subject to availability. An advance token payment is required to confirm bookings, which acts as a retainer for the vendors.
Any disputes regarding the immediate quality of hotel rooms, food, or driver behavior should be raised on the spot with the respective service provider and our local support team for immediate mediation. While we strive to ensure a high standard of service, we are not legally bound to issue refunds for services already consumed or due to third-party vendor defaults.
5. Force Majeure
ChitrakootYatra.com shall not be liable for any failure to perform our obligations if such failure is the result of Acts of God (including fire, flood, earthquake, storm, or natural disasters), war, civil unrest, government curfews, pandemics, strikes, or sudden road closures. In such events, we will make reasonable efforts to adjust itineraries, but refunds will be subject to vendor policies.
6. Governing Law & Jurisdiction
These Terms and Conditions shall be governed by and constructed in accordance with the laws of India. Any legal dispute, controversy, or claim arising out of or in connection with these terms, or the breach thereof, shall be subject to the exclusive jurisdiction of the competent courts located in Chitrakoot / Satna, Madhya Pradesh/Uttar Pradesh, India.
